It is the result of indiscriminate and disproportionate attacks in which the Military forces, the national Police forces and civil persons made use of unconventional artifacts ( manipulated ammunition, “papas” bombs with splinters), conventional arms (flamethrower, burst fire from conventional armory, splinter grenades,

MGL grenades, mortar grenades, stun grenades, teargas- launched from the ground and the air) against the gathering of humble peasants that participated in the NATIONA DAY OF PROTEST AND INDEFINITE

STRIKES located in the town center of Mojarras in the municipality of Mercaderes in the department of Cauca.

In the southwest of Colombia, Departement Cauca,Thursday, September 5
Municipality of Mercaderes, in the streets of Mojarras, the place where 10.000 peasants gathered to participate in the NATIONAL DAY OF PROTEST AND INDEFINITE STRIKES. th, 2013

Between 2:00 and 2:40 in the morning when most of the peasants were still asleep, two war-planes circled the area and launched 10 Bengali fires. Later that night, armed military helicopters landed close to the occupied road and to drop of soldiers nearby.

At around 6:30 in the morning, a group of soldiers of the Colombian military that was located around the place released a few rounds of ammunition into the air.

At around 7:10 in the morning, members of the army, agents of the highway Police, members of the AntiRiot-Squad – ESMAD (Escuadrón Móvil Anti Disturbios) initiated an intense indiscriminate attack in which

they launched teargas projectiles (From the air (helicopter) and from the ground), burst fire from conventional armory, splinter grenades, MGL grenades, mortar grenades, stun grenades, Flamethrower, buck shots, rubber bullets, manipulated projectiles, and “papas” bombs on the civilians and their goods.

A group of soldiers and civil people were located in the houses of the village people from where they realized further gunshots against the gathered peasants.

An official from a high position of the army, swarthy and thick, gave orders to his command when to open fire and which targets should be aimed.

Several commercial establishments and civil properties received impacts of gunfire in their facades. As soon as the combined state and parastate forces reached the central camp of the peasants they started to burn the belongings of the peasants and extensively cultivated pastures.

Likewise the peasants ALVEIRO MENESES and WILLIAM GUERRERO were detained arbitrarily by agents of the Police.

As a result of this insane attack the following peasants were injured: FLEIDER ORTEGA GALINDEZ, HOOVER CRUZ BURBANO, WILSON IDROBO, HAMILTON ESNEIDER SOLARTE MOSQUERA, VICTOR

ALFONSO ORTEGA, JUSTINIANO DE LA ENCARNACIÓN ENRRIQUEZ, JENNIS ANTONIO DE LA ENCARNACIÓN ZUÑIGA, MILTON CAMILO AVIRAMA GONZALEZ, JONAIVER BENITES QUINAYAS, YEFER ARNOLDO BOLAÑOS SAMBONI, FERNANDO HURTADO MENA, OVER ADELMO HOYOS GÓMEZ, JHON JAMES CALVACHE, JAIME DIAZ, CAMILO AVIRAMA, JUSTINIANO ENRRIQUEZ, JONER MAYUNGA, , RAFAÉL DÍAZ, FABIAN MARTINEZ, YONNY RODALLEGA y CARLOS ROJAS

Although official authorities of the department and the public ministry were immediately informed about the state of the injured persons, two hours passed unit the first ambulances were able to reach the location from where they initially proceeded to move the group of state agents allegedly wounded during the confrontation.

Close to 10:00 in the morning DEIVIN JESUS HURTADO ERAZO, member of la Red de Derechos Humanos “Francisco Isaías Cifuentes” receives a call from one of the army commanders located in the area with the aim of finding a way to suspend the confrontations by establishing negotiations or between officials of the combined forces and him as well as two spokesman that are allowed to accompany him.

When the citizen DEIVIN JESUS HURTADO ERAZO pressed to realize the announced humanitarian mediation he was hit by splinters that seriously injured him.

Despite the excessive repression of which they were object, the peasants tried to pick up their hurt fellows and guide them to a save place, located on the riverbank of the Río Patía next to the bridge of Puerto Nuevo of the municipality Leiva.

At around 2:30 pm a humanaitarian comission established by the Defensoría Regional del Pueblo, La Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos in Colombia and delegates of the Red de Derechos Humanos del Suroccidente Colombiano “Francisco Isaías Cifuentes” and the comisiones de Derechos Humanos del Movimiento Político y Social Marcha Patriótica en el Departamento del Cauca y de la Mesa Agropecuaria y Popular de Interlocución y Acuerdo – MIA arrive at the Bridge of Puerto Nuevo of the municipality Leiva.

As part of the humanitarian mission on the basis of field observations and testimonies of peasants, of officials of the Defensoría del pueblo present in the area during the occurring repressions, of Personeros Municipales (also state officials) in the zone, of members of medical missions and Journalists , the following facts were

Noted:

• That the group of militaries has installed a military checkpoint on the street of La Barca in the municipality Balboa (the only possible exit for the gathered Peasants)

• The disproportionate repression of which the group of Peasants were object.

• The relationship of six police men for every four soldiers and armed civil persons in the development of the crackdown

• The state of health of some of the injured

• The place of entry used by the military forces was located at the bridge Marañón. Just the same place on which a humanitarian commission conducted a mediation mission that achieved the release of six soldiers and one policemen that infiltrated the Peasant Strike, in exchange for access to medical service during the strike and the permission for engineers of the INVIAS to estimate the state of the bridge.

• Some of the present people stated that in the zone as a result of the military mission a massacre has been committed in which four persons have been murdered, under them a child of 6 years.

• Despite the difficulties of the entry of the medical mission due to the intense repression executed by the combined forces of the Colombian state, finally a group of peasants was broad to the hospitals of the city Popayán:

At about 11:00 pm in the Clínica la Estancia de Popayán the death of VICTOR ALFONSO ORTEGA from the municipality Leiva caused by a serious brain injury was confirmed. He didn’t survive the severe injuries the

Military and Police forces had inflicted him.

Against the ongoing repression of the Army and Police the Peasants resist their fear and remain in their positions

The Colombian government headed by Mr. JUAN MANUEL SANTOS CALDERON, the governor of the department Cauca TEMISTOCLES ORTEGA NARVÁEZ and specially the Coronel JULIO PINZÓN ARÉVALO commander of the twenty-ninth brigade of the National Army and the lieutenant RICARDO AUGUSTO ALARCÓN CAMPOS commander of the Police of Cauca for the violations of the international law and human rights and the violations of the international humanitarian law committed by members of the regular and irregular forces of the Colombian state.

We demand:

State responsibility over the principle rights of live, the personal security, the physical and psychological integrity, the personal privacy within the boundaries of family and home, the honor and liberal mobility of participants of the NATIONAL STRIKE, that see themselves inhibited by the arbitrary actions of the regular and irregular forces of the Colombian state.

FROM THE COLOMBIAN STATE

• The immediate compliance of recommendations, repeatingly formulated by the Commission for Human Rights of the UN and other international bodies

• Advance the necessary steps to guarantee over the principle rights of live, the personal security, the physical and psychological integrity, the personal privacy within the boundaries of family and home, the honor and liberal mobility of participants of the NATIONAL STRIKE, that see themselves inhibited by the arbitrary actions of the regular and irregular forces of the Colombian state

• Develop the legal actions that are needed to determine the collective and individual responsibilities in the case of violations of the international law and human rights and the violations of the international humanitarian law, pointed out in this special report
